AAP Pleased with 11th Circuit Court of Appeals Ruling

We are pleased that a unanimous panel of the 11th circuit US Court of Appeals today agreed to reverse the District Court’s judgment; vacate the injunction, declaratory relief and award of costs and fees; and remand for further proceedings consistent with its opinion. The three-judge panel agreed that the District Court erred in key aspects of its analysis of the fair use exception. AAP believes that today’s decision will help to protect the intellectual property rights of authors and publishers who are providing students with high-quality educational materials.

When we have reviewed the lengthy opinions of the 11th Circuit Court panel, we will be able to comment further.
